Urantia Foundation's EXCERPTS FROM COURT
MR. FOLCHER (for the Foundation): "But, your Honor, I think the most telling aspect of this, if you think the book's really in the public domain, and by the way it's not a religious book, it's got a lot of historic and scientific, but if you think it's really in the public domain why do you sneak around distributing copies on the disk?" MR. FOLCHER: "Your Honor, the Urantia Foundation is a non-profit corporation, doesn't qualify under the IRS as a religious organization. For instance, the IRS sets up 14 criteria for determining what's a religious organization, what's a church, and the Foundation doesn't meet any of those that I know of." MR. FOLCHER: "First of all, it is a work for hire. It can be renewed. The work does qualify as a work for hire, part of work by the author, who's discussed in the Burton case.
The Foundation, Your Honor, didn't appeal the Burton case. It was a favorable decision. They didn't believe that all the facts were totally accurate either about the authorship.
There was a trustee of the Urantia Foundation, William Sadler, Jr., not senior, who wrote, authored, however you want to look at it, parts of The Urantia Book. And that was part of the work, and it was clearly work for hire, also a joint work. And that was also a basis for the renewal." (from page 27 of the Proceedings for March 15, 1991, Jean M. MR. FOLCHER: "If we're going to stop this thing, it's like a computer virus, it's growing, from destroying the market for The Urantia Book, we're going to have to track it down to the lowest levels and find out everybody who got a copy and compel them not to make more copies." MR. FOLCHER: "Your Honor, the only people who are allowed to wear the collective membership mark at this point because of termination of the national Brotherhood license are members of the San Fernando Urantia Society and the Western Springs Urantia Society.
